§ 2. Applicability
For the business relation between transcript Verlag (hereafter: seller) and the purchaser, only the terms and conditions printed here, in the version current at the time of the order, apply.

§ 3. Orders
You are free to browse our selection as long as you please. When you have found something interesting, put the product into your virtual shopping cartby clicking the button "Add to shopping cart". Of course, you can always remove products from the shopping cart at any time.
You initiate the ordering process by clicking on the button "Proceed to checkout" in the shopping cart. Next, you can log in with your user information or register an account as a new customer. Of course, you can also order from us without an account. Please enter your personal information such as name, address, etc., so we can accept your order. Correct fields required for processing your order will be highlighted green. In case of any incorrect or missing inputs, the respective fields will be highlighted red, and the order cannot be processed. Before clicking on "Zahlungspflichtig bestellen" ("buy now"), your information will be displayed once more. Please check for accuracy and correct if necessary. Here, you also receive an overview of all products in your shopping cart. You can now remove any or all products from the shopping cart.
In this overview, you are also shown the total costs of your order. After reading our terms and conditions, please tick off "Ich habe die AGB Ihres Shops gelesen und bin mit deren Geltung einverstanden" ("I have read the terms and conditions of your shop and agree to them"). Should there be an e-book among the items in your shopping cart, please also tick "Ich stimme ausdrücklich zu, dass Sie vor Ablauf der Widerrufsfrist mit der Ausführung des Vertrages beginnen. Mir ist bekannt, dass ich durch diese Zustimmung mit Beginn der Ausführung des Vertrages mein Widerrufsrecht verliere." („I explicitly agree to the performance of the contract before the end of the cancellation period. I understand that this renders my cancellation rights void at the beginning of the performance of the contract"). Then, choose your preferred payment option. You can choose from purchase on account, credit card, direct debit, or Sofortüberweisung (purchase on account is not available for e-books). To send the order, please click on "Zahlungspflichtig bestellen" ("buy now"). After clicking "Zahlungspflichtig bestellen" ("buy now"), you will be asked to enter your payment information. After doing so, please click on "pay now" to complete the order. If you buy usage rights to a digital product, the file will immediately be made available to you. In the order confirmation you will receive via e-mail, you will find a link for downloading your e-book. Alternatively, you can also download your e-book via the link "download e-book" in the order overview. A customer account is necessary for ordering books from the transcript-shop. You will find all the e-books purchased under "my e-book purchases" in your account (see customer account and digital bookshelf on our service pages).
At any point during the order process before sending your order via the button "buy now", you can edit or delete your information by clicking on "edit" or "X". To edit or delete an order quantity, re-enter the desired quantity in the field and click "OK". By clicking "buy now", the order is placed and forwarded to us. Your order is a binding expression of your intention to purchase the products from us.

§ 4. Conclusion of Contract for Print Products
By ordering, you enter into a contract with: transcript, Roswitha Gost & Dr. Karin Werner GbR, Hermannstrasse 26, 33602 Bielefeld, Germany.
Upon arrival of your order, you immediately receive an e-mail notification with the subject "Ihre Bestellung im transcript Verlag" ("Your Order from transcript Verlag"). The order confirmation is automatic and does not constitute acceptance of a contract. The purchase agreement arises when we confirm accepting your order and thus the conclusion of the contract via another e-mail entitled "Versandbestätigung" ("Shipping Confirmation"). This message is sent immediately, at the latest five days after we receive your order. The contract including your order is saved by us and can be sent to you together with our terms and conditions upon request. The language available for the conclusion of the contract is German.

§ 5. Special Terms for Buying Usage Rights to Digital Products

5.1) Digital Products: Conclusion of Contract
You purchase the usage right for digital products when there is at least one e-book (e-pub or PDF via download) in your shopping cart. The following conditions apply: The contract is concluded among buyer and seller according to these terms and conditions, if the buyer, having provided his personal data and selected the desired contents, requests the download link per mouse click. The user commits to truthfully and completely entering the required information. The purchasing contract is concluded by the seller by making the file available for download. Any status messages do not constitute accepting the offer. The language available for the conclusion of the contract is German.

5.2) Digital Products: Extent of Usage Rights
By concluding the contract, the buyer acquires non-exclusive, non-transferable, spatially and temporally unlimited usage rights to the download contents for exclusively private purposes. Passing on these contents to third parties is forbidden, and any commercial use requires our prior agreement or separate licensing. Copyright notices etc. may not be removed and the buyer is not entitled to alter, edit, publicly display these contents, or make them available for download.
We reserve the right to use soft DRM (watermarks) for copyright protection.

5.3) Digital Products: No Right of Withdrawal
For goods that are accessed via download (e-book files), the publisher initiates delivery before the beginning of the period of revocation. Therefore, the right of withdrawal is voided for the purchase of usage rights for digital products in our shop. During the order process, the customer is required to tick off "Ich stimme ausdrücklich zu, dass Sie vor Ablauf der Widerrufsfrist mit der Ausführung des Vertrages beginnen. Mir ist bekannt, dass ich durch diese Zustimmung mit Beginn der Ausführung des Vertrages mein Widerrufsrecht verliere" ("I explicitly agree to the performance of the contract before the end of the cancellation period. I understand that this renders my cancellation rights void at the beginning of the performance of the contract"). A valid order is only possible after this box has been ticked. By ticking it, the customer confirms his awareness of the publisher initiating delivery of the product before the beginning of the period of revocation and of the fact that this renders the right of withdrawal void.

5.4) Digital Products: No Temporal Limits
After purchasing the usage rights to an e-book, there is no time limit for the download.

5.5) Digital Products: Number of Downloads
You can download the product only twice. Afterwards your e-book will be available for you without timely limitation in your transcript bookshelf in your customer account on our website: www.transcript-verlag.de.

5.6) Digital Products: Product Properties and System Requirements
Format: Our digital products are available as PDF and E-Pub. The available versions of a product can be found on the respective product page. Here, you can select the desired format.
PDF: PDFs are best suited for use on a PC or Laptop. For this a current version of the free Adobe Reader or the (also free) software Adobe Digital Editions for example, is required.
E-Pub: Usually, E-Pubs are read on e-book-readers, tablets, or smartphones with e-pub reading software. However, our E-Pubs can also be read on a PC or Laptop with the right reading software (e.g., Adobe Digital Editions).
File size: The space required on your reader or PC for our E-Pubs is between 0.5 and 10 MB. The space required for our PDFs is between 0.5 and 300 MB.
Copy Protection: Our e-books are not protected with technical safeguards, but they bear watermarks. Thus, you can use the files without restrictions. However, the files contain buyer-specific information (e.g., e-mail address, customer number, order number, etc.), which cannot be removed. This watermark allows us to track down illegitimate copies to the original purchaser. When adding the watermark, we adhere to the data protection rules that apply to any purchase in our shop.

5.7) Digital Products: Payment
Invoice orders are not available for digital products. You can choose from credit card, direct debit, and Sofortüberweisung for payment. After clicking on the button "Zahlungspflichtig bestellen" ("buy now"), you are asked to provide your payment information. Then, click on "Jetzt bezahlen" ("pay now") to complete the order. The digital product is then immediately available for download.

5.8) Digital Products: Using the transcript-Bookshelf
Customers may use the products made available online in person and for private purposes only. They are not allowed to make the bookshelf available to third parties or to pass on contents to third parties.
Customer access to online products via the internet is password protected. The customer is legally required to keep his log-in information and password secret and protected from misuse by third parties. In this context, we wish to point out that our employees are not allowed to ask for passwords on the telephone or in writing. If log-in information or passwords are lost, or if they suspect these data to have been misused, the customer is required to notify us immediately. Furthermore, we are entitled to block access to online products in case of misuse. Customers shall be liable for any misuse for which they are responsible.
Availability: The bookshelf is available seven days a week and 24 hours a day in principle. We are entitled to limit, or to partially or completely interrupt these services to a reasonable degree for maintenance.

§ 6. Notice of Cancellation for Orders of Print Books and Other Physical Goods
Consumers are entitled to the legal right of cancellation. A consumer means every natural person who enters into a legal transaction for a purpose that is outside his or her trade, business or profession. (§ 13 BGB).

Right of Withdrawal

You are entitled to cancel this contact within fourteen days without stating reasons. The withdrawal period is fourteen days, starting with the day you, or a third party specified by you who is not the carrier, have or has taken possession of the goods.
To make use of your right of withdrawal, you must notify us (transcript Verlag, Hermannstrasse 26,33602 Bielefeld, Tel.: +49 (0) 521-39 37 97 0, Fax: +49 (0) 521-39 37 97 34, E-mail: vertrieb@transcript-verlag.de) of your decision to withdraw from this contract with a clear statement (e.g., a letter sent via mail, fax, or e-mail). For this, you may, but need not, use the model withdrawal form. The model withdrawal form can be found at: www.transcript-verlag.de/withdrawal-form

To maintain the withdrawal period, it is sufficient to send the notice of withdrawal before the end of the withdrawal period.

Consequences of Withdrawal
If you withdraw from this contract, we are bound to pay back any payments we received from you, including delivery costs (excluding additional costs for any other kind of delivery you have chosen over the affordable standard delivery offered by us), immediately and at the latest within fourteen days from the day we received your withdrawal notice. For this refund, we use the same payment method you used for the original transaction, unless something else has been expressly agreed upon with you; under no circumstances will you be charged for this refund.
We can withhold payment until we have received the products again or until you have proven that you sent back the products, depending on which comes first.
In any case, you are required to send or give back the products to us within a maximum of fourteen days after the day you notified us of your withdrawal from this contract. This term is maintained if you send the products before the end of the term of fourteen days. You bear any immediate costs for sending back the products.
You are only charged for any eventual decline in the worth of the products if this decline can be linked to any treatment not necessary for the inspection of quality, properties, and working principle of the products.

Suspension and premature Termination of the Right of Withdrawal
There is no right of withdrawal for deliveries of audio or video recordings (e.g., CDs, audio or video tapes) or computer software if the sealed packaging has been opened after delivery.
There is also no right of withdrawal for products which are not prefabricated and for whose production an individual choice or specification by the consumer is required, or which are specifically tailored to the consumer's personal needs. Furthermore, there is no right of withdrawal for contracts about the delivery of newspapers, journals, or magazines, excluding subscription contracts.

§ 7. Notice of Cancellation for Orders of Digital Products
For products that are obtained via download (e-book files), we initiate delivery before the beginning of the cancellation period. Therefore, the right of withdrawal terminates with regards to e-books upon purchase of usage rights for digital products in our shop. During the order process, the customer is asked to tick "Ich stimme ausdrücklich zu, dass Sie vor Ablauf der Widerrufsfrist mit der Ausführung des Vertrages beginnen. Mir ist bekannt, dass ich durch diese Zustimmung mit Beginn der Ausführung des Vertrages mein Widerrufsrecht verliere" ("I explicitly agree to the performance of the contract before the end of the cancellation period. I understand that this renders my cancellation rights void at the beginning of the performance of the contract"). A valid order is only possible after this box has been ticked. By ticking it, the customer confirms his awareness of the publisher initiating delivery of the product before the beginning of the period of withdrawal and of the fact that this renders the right of withdrawal void.

§ 8. Reservation of Non-Availability
We reserve the right to refrain from executing your order if we do not have the ordered title in stock, the out-of-stock title is no longer available, and your order is thus not available. In this case we will immediately notify you of the non-availability and immediately refund any purchase price you have already payed.

§ 9. Prices and Shipping
Our prices are final retail prices in Euro. They contain statutory value added tax.
Because books are subject to legal price maintenance in Germany, the book price set by the seller is mandatory.

There are no shipping costs for private customers within Germany.
For shipping outside of Germany and for discount copies (authors' discount, courtesy discount), the following shipping costs apply:

GERMANY
        1 copy: 1.50 €
        up to 3 copies: 4.00 €
        up to 5 copies: 5.00 €
        more than 5 copies: 6.50 €

EUROPE (outside Germany)
        1 copy: 4.00 €
        up to 3 copies: 10.00 €
        up to 5 copies: 14.50 €
        up to 10 copies: 20.00 €
        more than 10 copies: 35.00 €

WORLD (outside Europe)
        1 copy: 5.00 €
        up to 3 copies: 12.00 €
        up to 5 copies: 20.00 €
        up to 10 copies: 45.00 €
        more than 10 copies: 85.00 €


Import Duties and Taxes:
Foreign orders may under circumstances be subject to additional import duties and taxes of the country of destination. These costs are charged to you. We do not have any influence on these fees and their amount.

§ 10. Payments
The purchase price is due for payment within fourteen days of invoicing and payable without deduction. Within Germany, you can pay by transfer after receipt of invoice, direct debit, credit card, Sofortüberweisung, or transfer after receiving an advance invoice. International orders can be payed via credit card, direct debit, or transfer after receiving an advance invoice.
If the customer is in delay of payment, the seller reserves the right to charge an arrears fee.

§ 11. Delivery
We deliver our products worldwide. Delivery usually takes between three and five business days within Germany and approximately one to three weeks outside of Germany after we accept your order by order confirmation. Unless otherwise agreed upon, delivery is made from our stores to the delivery address given by the customer. Please make sure that your billing and shipping address(es) are correct and complete. Renewed delivery due to an incorrect or incomplete address as well as the costs for returned shipments will be charged to you. Should the products be undeliverable due to a longer absence, we also charge you the costs for renewed shipment. The invoice is also packed with the products in case of an alternative shipping address. If you expressly require separate shipping of products and invoice, we charge you an additional fee of 1.00 €.

§ 12. Journal Subscriptions
All journals are available for annual subscription directly from the publisher.

We use the data provided by you to fulfill and process your order. The buyer expressly approves gathering, processing, and usage of the data received pertaining the business relationship. Your information will be passed on to the carrier charged with delivery to the extent necessary for delivering your products. For payment processes, we may pass on your payment information to our bank. Your information is not passed on to any other third parties or used for advertisement purposes. We protect our website and other systems against loss, destruction, and unauthorized access, manipulation, or processing of your data by technical and organizational means. However, in spite of regular checks, a complete protection against all threats is not possible.
Under German federal data protection law, you are granted the right to free information about your stored information, as well as a right to correction, barring, or deletion of this information. The merchandise shall remain the property of the seller until the receipt of full payment from the customer.

§ 15. Warranty
Statutory warranty rights apply.

§ 16. Applicable Law and Jurisdiction
The law of the Federal Republic of Germany shall apply, excluding United Nations purchasing laws.
If the customer is a salesperson or a legal entity under public law, exclusive jurisdiction for all disputes from the contractual relation lies with the court responsible for our company headquarters in Bielefeld.
